Polk County District Attorney Reacts to Cannon Murder Case Evidence Revelation

This afternoon, Polk County District Attorney Stan Butterfield reacted to the revelation of missing evidence in the 1998 triple homicide murder trial of Phillip Scott Cannon had been discovered in Oregon Department of Justice offices. Butterfield said "At this point I have more questions than answers as to the future course of this case. There are many possible implications involving this evidence; only time and a careful review of the facts surrounding its disappearance and rediscovery will tell the story."

Butterfield said he had personally called representatives of each of the victim families immediately after the Attorney General broke the news to him. Butterfield reiterated his earlier statement regarding the case: "This is an open murder investigation; I will have no further comment."

HART Detectives continue their work on the investigation of the shooting that occurred Sunday morning.

The victim has been identified as David A. Polanco, 23, of Salem. Polanco was found dead at the scene, having suffered multiple gunshot wounds. An autopsy is scheduled for later today.

Witnesses provided detectives with the description of a suspect vehicle and two suspects seen leaving the scene immediately after the shootings. The vehicle, a 2003 Ford Explorer, had a California license plate and tinted windows. It was occupied by two male subjects.

Law enforcement agencies from throughout Oregon and California were asked to watch for the vehicle and to detain its occupants. At approximately 11:30am, Sunday, officers from California Highway Patrol, assisted by deputies from the Siskiyou County Sheriff's Office and officers from Yreka Police Department the stopped the suspect vehicle after spotting it traveling southbound in Interstate 5, near milepost 777 in Yreka, California.

The occupants were identified as Nicholas Chavez, 29, and Jhosuamil Colon Lebron, 18. No resistance was offered by Chavez or Colon Lebron.

Both subjects are being detained at the Siskiyou County Jail on murder charges. Chavez and Colon Lebron have addresses in California and Oregon. The relationship between the victim and suspects is not being released at this time. The motive for the shooting remains unknown.

The time line for the return of Chavez and Colon Lebron to Oregon will be developed after they appear in court in California later this week.

Detectives are continuing their investigation into the shooting death that occurred at the Devonshire Court Apartments, on Devonshire Avenue NE earlier this morning.

We are processing a search warrant for the apartment and, once signed, Detectives will conduct a thorough search to collect forensic evidence.

Preliminary investigation indicates that the victim died of homicidal violence, but no further information is being released regarding how he was killed. The motive for the shooting is not clear at this time.

Detectives are still working to identify the victim and notify his family. His name will not be released until the notification is made.

Leads have developed and Detectives are interviewing more than one person of interest.

No arrests have been made, but we feel there is no further immediate danger to the local community as a result of this shooting.

Our Deputies responded to a call of "shots fired" at an apartment in the 4100 block of Devonshire Avenue, NE in Salem.

They arrived within minutes of the call to find a deceased male adult in the apartment. He has not been identified at this time.

The investigation is on-going. There is no further information available for release at this time. Updates will be issued as information becomes available.

Nude Suspect Arrested After Fleeing Deputy

A 22-year old Salem man was arrested this morning after fleeing from a Marion County deputy who was trying to arrest him for illegally entering parked cars. The incident occurred at 9:27am, near the intersection of Lancaster Drive and State Street in Salem.

Traffic Safety Deputy Casey Burnham was on patrol when a car owner flagged him down. She reported that a man had just entered her 2007 Dodge pick-up truck while it was parked at the Ritz Restaurant, 135 Lancaster Drive NE.

The woman pointed out the suspect, who was now running across Lancaster Drive toward the Walgreens store at 124 Lancaster Drive. Burnham followed the suspect into Walgreens and later spotted him as he came out of a dressing room, wearing nothing by a jacket. He was nude from the waist down.

Deputy Burnham attempted to arrest him, but he fled and resisted. As he fled, he discarded the jacket he was wearing. Witnesses assisted the deputy by pointing out the suspect's route as he fled. Burnham ultimately caught up with him and deployed a Taser to take him into custody.

Daniel Z. Gilani, who described him self as a transient, was booked into the Marion County Jail and held on charges of unlawfully entering a vehicle, resisting arrest and disorderly conduct.

It was determined that he was on parole for a prior conviction for possessing methamphetamine. His supervising Parole & Probation Deputy placed a parole violation detainer on him. He will appear in court on 10/17/121 at 3:00pm. Until then, he is being held without bail.
