Defendants Sentenced in 8-29-10 Salem Murder, Assault & Robbery

DEFENDANTS SENTENCED IN 8-29-10 SALEM MURDER, ASSAULT & ROBBERY

Andy Huerta (DOB 4-15-92) was sentenced today by Marion County Circuit Court Judge Joseph C. Guimond on three separate counts of Murder, Attempted Aggravated Murder and Robbery stemming from a crime spree in Salem on 8-29-10. Huerta was represented by attorneys Thomas Sermak and Jessica Kampfe, both of the Marion County Public Defenders Office. Judge Guimond sentenced Huerta to a life term for Murder with a 25 year minimum and 120 months prison for the Attempted Aggravated Murder. 105 months of that sentenced shall run consecutively to the Murder sentence. A 70 month prison sentence on the Robbery will run concurrently.

Similarly, Martin Covarrubias-Rivera (DOB 8-26-94) was also sentenced today by Judge Guimond on three separate counts of Murder, Attempted Murder and Robbery stemming from that same crime spree. Covarrubias-Rivera was represented by attorneys Stephen Lipton and Mark Geiger. Covarrubias-Rivera received a life term in prison for the Murder with a 25 year minimum, and 90 months in prison for Attempted Murder which shall run consecutively. A 70 month prison sentence for the Robbery will run concurrently.

Both defendants first robbed a Plaid Pantry in Salem and were arrested shortly after reports to police regarding the murder of 68 year-old Salem resident, Austreberto Morales, and a subsequent knife attack on Robert Marsh who was on his way to work. Mr. Morales suffered nine stab wounds and collapsed and died just yards from his home near the Lancaster Mall. Mr. Marsh survived his injuries. Both victims were strangers to the defendants and did nothing to precipitate the attacks.
