Polk County District Attorney Reacts to Cannon Murder Case Evidence Revelation

This afternoon, Polk County District Attorney Stan Butterfield reacted to the revelation of missing evidence in the 1998 triple homicide murder trial of Phillip Scott Cannon had been discovered in Oregon Department of Justice offices. Butterfield said "At this point I have more questions than answers as to the future course of this case. There are many possible implications involving this evidence; only time and a careful review of the facts surrounding its disappearance and rediscovery will tell the story."

Butterfield said he had personally called representatives of each of the victim families immediately after the Attorney General broke the news to him. Butterfield reiterated his earlier statement regarding the case: "This is an open murder investigation; I will have no further comment."

HART Detectives continue their work on the investigation of the shooting that occurred Sunday morning.

The victim has been identified as David A. Polanco, 23, of Salem. Polanco was found dead at the scene, having suffered multiple gunshot wounds. An autopsy is scheduled for later today.

Witnesses provided detectives with the description of a suspect vehicle and two suspects seen leaving the scene immediately after the shootings. The vehicle, a 2003 Ford Explorer, had a California license plate and tinted windows. It was occupied by two male subjects.

Law enforcement agencies from throughout Oregon and California were asked to watch for the vehicle and to detain its occupants. At approximately 11:30am, Sunday, officers from California Highway Patrol, assisted by deputies from the Siskiyou County Sheriff's Office and officers from Yreka Police Department the stopped the suspect vehicle after spotting it traveling southbound in Interstate 5, near milepost 777 in Yreka, California.

The occupants were identified as Nicholas Chavez, 29, and Jhosuamil Colon Lebron, 18. No resistance was offered by Chavez or Colon Lebron.

Both subjects are being detained at the Siskiyou County Jail on murder charges. Chavez and Colon Lebron have addresses in California and Oregon. The relationship between the victim and suspects is not being released at this time. The motive for the shooting remains unknown.

The time line for the return of Chavez and Colon Lebron to Oregon will be developed after they appear in court in California later this week.

We are processing a search warrant for the apartment and, once signed, Detectives will conduct a thorough search to collect forensic evidence.

Preliminary investigation indicates that the victim died of homicidal violence, but no further information is being released regarding how he was killed. The motive for the shooting is not clear at this time.

Detectives are still working to identify the victim and notify his family. His name will not be released until the notification is made.

Leads have developed and Detectives are interviewing more than one person of interest.

No arrests have been made, but we feel there is no further immediate danger to the local community as a result of this shooting.

A 22-year old Salem man was arrested this morning after fleeing from a Marion County deputy who was trying to arrest him for illegally entering parked cars. The incident occurred at 9:27am, near the intersection of Lancaster Drive and State Street in Salem.

Traffic Safety Deputy Casey Burnham was on patrol when a car owner flagged him down. She reported that a man had just entered her 2007 Dodge pick-up truck while it was parked at the Ritz Restaurant, 135 Lancaster Drive NE.

The woman pointed out the suspect, who was now running across Lancaster Drive toward the Walgreens store at 124 Lancaster Drive. Burnham followed the suspect into Walgreens and later spotted him as he came out of a dressing room, wearing nothing by a jacket. He was nude from the waist down.

Deputy Burnham attempted to arrest him, but he fled and resisted. As he fled, he discarded the jacket he was wearing. Witnesses assisted the deputy by pointing out the suspect's route as he fled. Burnham ultimately caught up with him and deployed a Taser to take him into custody.

Daniel Z. Gilani, who described him self as a transient, was booked into the Marion County Jail and held on charges of unlawfully entering a vehicle, resisting arrest and disorderly conduct.

It was determined that he was on parole for a prior conviction for possessing methamphetamine. His supervising Parole & Probation Deputy placed a parole violation detainer on him. He will appear in court on 10/17/121 at 3:00pm. Until then, he is being held without bail.

At about 11:17am, Marion County Deputy Aaron West and Reserve Deputy Jason Remmy came upon a single vehicle truck crash on Jefferson- Marion Rd just south of D Street in Marion.

They discovered a 2010 Freightliner,18-wheeler stopped in the roadway. The rear trailer had separated from the tractor and was overturned in the ditch on the side of the road. The trailer contained milk that was spilling into the ditch. The truck was owned by LTI, Inc. from Lynden, WA.

The driver was identified as Gary Schneider, 58, of Salem. He told deputy West that he was traveling southbound on the Jefferson-Marion Road when he got distracted reaching for his lunch bag. The rear trailer left the roadway and rolled over several times.

There were no other vehicles involved in the crash and no one was injured. The milk posed no hazard. The roadway was closed several hours to allow for clean up and removal of the trailer. There is no estimate on the amount of milk that was spilled.

Mr. Schneider was cited for Failing to Drive Within Lane.

Polk County Circuit Court Sentences Sex Offender to 10 Years in Prison

Judge William Horner, Polk County Circuit Court Judge, sentenced Anthony Abraham to over 10 years in prison for one count of Unlawful Sexual Penetration in the First Degree and two counts of Sexual Abuse in the First Degree.

The charges were based on a 2009 incident, in which Abraham, then 20 years old, sexually abused a 15 year old girl. The enhanced sentence was based on aggravating factors, including Abraham's previous criminal convictions. Abraham has three prior felony convictions out of Marion County, one for Assault in the Fourth Degree and two for Rape in the Third Degree.

A 48-year old Jefferson man is lucky to be alive this morning after being arrested for pointing a loaded firearm at a Marion County Sheriff's deputy.

Deputy Cliff Self was working a routine patrol shift at about 9:15pm Monday evening. He was sitting in his parked patrol vehicle in the parking lot of the Jefferson Grade School, 615 North 2nd Street. Self noticed a red laser dot on his chest. From his experience and training, he realized he was in imminent danger as lasers are often attached to firearms and used to aim at targets.

The deputy immediately called for back up, but also knew he had to react to the threat posed to his personal safety. He determined that the laser was being aimed from a motor home, parked across the street from the school.

As he approached the motor home in the darkness, he could see that the laser was still aimed at his chest. With his duty weapon drawn, he took the suspect, Michael Coats, into custody.

Following Self's commands, Coats dropped the laser equipped, loaded Kimber Model 1911 .45 caliber semi-auto pistol. The weapon obviously posed a significant threat to the deputy. A search of the suspect's motor home revealed a silencer for the Kimber, a holster, a look-a-like .177 pellet handgun, a hunting knife, a sword and numerous rounds of ammunition.

Coats told the deputy he pointed the laser and weapon at him because the lights from the patrol vehicle were disturbing him. He claimed not to realize the marked patrol car was a law enforcement vehicle. Deputy Self was also wearing a Sheriff's Office patrol uniform.

Enforcement Commander Eric Hlad commented, "Mr. Coats is extremely fortunate that Deputy Self's training and experience provided him options to employing the use of deadly force. This incident could well have ended in tragedy."

Coats, who was intoxicated at the time of the incident, was booked at the Marion County jail on charges of menacing, reckless endangerment, unlawful use of a firearm and point a weapon at another. He will appear in court at 3:00pm, Tuesday. Until that time, he is being held on $27,500 bail.

Perla Cota and Luis Delgado-Flores were taken into custody in the parking lot of the West Salem Courthouse athletic club. Ms. Cota faces charges of Unlawful Possession and Delivery of Heroin. Both Ms. Cota and Mr. Delgado also face charges of Conspiracy.

Investigators seized over a pound of Heroin, packaging materials, scales, drug records and over $3,300.00 in cash as a result of the investigation.

Polk County Vehicle Pursuit - Need Public Assistance

On October 6th at approximately 7:00pm, the Polk County Sheriff's Office was notified by the Benton County dispatch center of a call on a vehicle that was reported weaving in and out of traffic and passing unsafely that was heading northbound on Hwy 99 near the Polk/Benton County line. At that time, the Benton County Sheriff's Office was attempting to catch up to the vehicle and Polk County responded to the area to assist with locating the vehicle.

When Polk County entered into the Monmouth area on Hwy 99, Deputy Todd Fenk located the vehicle and the Benton County Deputy who at that time was in pursuit of the vehicle at speeds of 80+ mph.

As the vehicle continued north on Hwy 99, the speed of the fleeing vehicle exceeded 100 mph and the driver began taking aggressive actions by driving head-on into the oncoming traffic forcing several vehicles to swerve to avoid being hit head on.

Oregon State Police joined the pursuit as it headed into Amity where the fleeing vehicle finally pulled over and the driver arrested. The driver who was identified at the scene as Stringham, Christopher (51 yrs) from Corvallis, Oregon was transported to the Polk County Jail on several charges. Those charges include Felony Elude, Reckless Endangering and Reckless Driving. The incident is currently under investigation by the Polk County Sheriff's Office.

At this time, the Polk County Sheriff's Office is seeking the public's help to identify any victims that may have had to swerve or take evasive measures to avoid being hit by Mr. Stringham during the pursuit on Hwy 99. In conjunction with National Fire Prevention Week, the Salem Fire Department will once again host its annual Fire Department Open House on Wednesday, October 12, from 5:00 to 8:00 pm, at the airport fire station/training facility located at 2740 25th Street SE in Salem, Oregon.

The annual event, which is focused on connecting with the community we serve, will include several learning opportunities for adults and children in the area of risk reduction, emergency preparedness, and fire safety. Fire department apparatus displays and demonstrations will take place during the event, including a technical rescue and vehicle extrication drill. Hands-on activities for kids include the popular Junior Firefighter Challenge and Life-Safety House.

Community partners such as the Community Emergency Response Team (CERT), American Red Cross, Willamette Valley SAFE Kids, and the 9-1-1 center will provide valuable information related to safety and preparedness. The Salem Public Library will also be on hand for library card registration.

The event is free and light refreshments will be available. Event parking is graciously provided by Hertz Car Sales, which is located adjacent to the fire department training facility.

Parents charged in toddler shooting

Today, Polk County District Attorney, Stan Butterfield, announced that the parents of a toddler who was the victim of an accidental gunshot wound have each been charged in connection with the case. The children's father Charles Andrew Flow, Sr. and mother, Johnnie Jean Williams of Dallas, Oregon were each charged with two counts of Recklessly Endangering Another Person.

The couple is alleged to have engaged in reckless conduct by leaving a loaded handgun in an area where the children were playing during the September 23, 2011 incident.
Authorities believe the two year old boy was accidentally shot by his three year old brother as the two boys were playing in the living room of the family residence.

The boys' parents are scheduled to be arraigned on October 13, 2011 at 9:00 a.m. in Courtroom 4, of the Polk County Courthouse.

The Keizer Fire District responded to the report of a house fire shortly after 2:00 am on Thursday, October 6, 2011. When units arrived on scene they observed heavy smoke and flames coming from the front and rear of the single family residence.

The call was received at 2:17 am for a fire at 565 Hornet Dr N in Keizer. Arriving fire crews found fire burning in the garage and kitchen area of the residence. The flames had traveled into the attic space and were spreading through the residence.

Firefighters were able to make a good aggressive stop of the fire. It was stopped from extending further from the garage and kitchen to the rest of the home stated Fire Chief Jeff Cowan.

Fire was found in the attic and under the house in the crawl space, it was difficult to extinguish the fire and created a very dangerous environment for firefighters to work in.

The home sustained substantial fire and smoke damage. Damage to the residence was estimated at $165,000 and damage to the contents was estimated to be $75,000. One vehicle that was parked in the garage was also damaged in the fire; its estimated loss is $3,000.

The home is owned and occupied by Ray and Donna Wilson. The Wilsons were out of town during the fire and had a house sitter to care for their four animals and the home.

The house sitter had gone to bed around 1:30 am and awoke 30 minutes later to the smell of smoke. Upon investigation she found the garage on fire. The house sitter then attempted to rescue the two dogs and two cats in the home before exiting herself. There were no working smoke alarms in the home.

Five engines, three medics, one duty officer vehicle, one air rig, one ladder truck, one fire investigation vehicle and 25 firefighters responded to the incident. No human injuries were reported: however one dog and two cats perished in the fire. Marion County Fire District One and Salem Fire Department responded as mutual aid to the call. One person was transported to the hospital with injuries.

Fire officials would like to remind residents to check your smoke alarms to ensure they are in working order. There should be at least one smoke alarm in every home, placed outside of sleeping areas. For two story homes a smoke alarm should be placed on each floor.

Keizer Fire recommends a smoke alarm on each floor, one in each bedroom and a smoke alarm outside the sleeping areas. This helps to ensure quick notification in case of a fire. If there is a fire in your home, exit immediately and do not return back into the home for anything.

Judge Joseph Guimond has announced that a hearing for death-row inmate Gary Haugen will be held on Friday, October 7th at 9:00am, in courtroom #1B at the Marion County Courthouse, 100 High Street, Salem.

Originally, this hearing date was set for an in-chamber status conference, but at the request of defense attorneys, Judge Guimond is planning to enter into a colloquy with Mr. Haugen to determine his mental competency to waive further appeals of his death sentence. This process will include asking Mr. Haugen a series of questions defined by statute.

KATU 2 will connect a live video feed to the courtroom. Consistent with the prior public access order (which remains in effect for this hearing), there will be no live broadcasting of the proceedings.

Body recovered in the Willamette River

On 10-01-11 at 2:29 PM Polk County Sheriff's Office deputies responded to a report of a body floating in the Willamette River in Buena Vista, an unincorporated area of Polk County south of Independence, OR. Also responding were Polk County Fire personnel, assisted by the Salem Fire Department water rescue boat team.

By 3:24 PM fire units had located and confirmed the presence of a dead body, approximately one quarter mile downstream (north) of the Polk County side of the Buena Vista Ferry landing. The body was later recovered by authorities at approximately 4:40 PM with the assistance of a boat operated by the Benton County Sheriff's Office marine patrol unit.

The body was identified as that of 63 year old Marvin Leonard Studer, a resident of the Buena Vista area. Studer had last been seen by family members September 9, 2011 at his home, a short walking distance from the Willamette. Relatives have indicated that it was not uncommon for Studer to spend time along the river. While cause of death and the reason for Studer being in the water have yet to be determined, there was no indication of foul play at the scene. Investigation by the Polk County Sheriff's Office will continue.

At this time, deputies are in the process of identifying her. Her name will be withheld until family notifications are made.

Both the conductor and engineer of the train told investigators the train was traveling approximately 46 mph when they observed something lying in the tracks ahead. Both indicated it is common to have garbage bags discarded on the tracks in this rural area. As the train got closer, they realized the object was a body lying between the tracks. They initiated procedures to stop the train, but the 2-engine, 2700' long freight train took almost a mile to stop. They were unable to avoid hitting the female.

A dozen Marion County Sheriff's Office employees and volunteers rolled up their sleeves and worked with the wait staff at the Applebee's restaurant on Lancaster Drive Thursday evening, September 22nd. It was all for a good cause; raising money to support the Special Olympics.

This was the 3rd year our Office has participated in the Tip-A-Cop program. Deputies, Office staff, Cadets and a Commander interacted with the patrons and collected a total of $1100 for the program.

"This was a wonderful opportunity to give back to our community. The patrons and restaurant staff were both pleased that we were there. I came away with a new-found respect for the wait staff at Applebee's. They're awesome" Commander Sheila Lorance commented.

Keizer Fire District firefighters were kept busy last night with two structure fires and five medical calls. The first structure fire was reported to 9-1-1 at 7:51 pm, when the Nichelle Martin was cooking dinner and smelled burning plastic. She checked the laundry room and kitchen area, but couldn't locate the source of the smell. One of her sons noticed smoke coming from the bathroom door, which was only open a crack. Upon opening the door fully they saw smoke and flames. The family then evacuated the house and called 9-1-1.

When firefighters arrived at 4915 Wolf St N, they found smoke throughout the home, and the bathroom on fire. The fire was quickly extinguished. Fire damage to the home was confined to the bathroom with smoke damage in parts of the house.

The home is owned and occupied by Robert Chapman, his fiancé Nichelle Martin, their six children, and roommates Elliot and Ashley Trimble and their son. They had a smoke alarm in the home; however it did not work. The home is insured and the family was able to stay there last night.

Two engines, one medic, one duty officer vehicle, one fire investigation vehicle and 11 firefighters responded to the incident. No injuries were reported and the cause of the fire remains under investigation.

The second fire was reported to 9-1-1 at 2:42 am when a paint shop employee was leaving work for the night noticed water coming out from the neighboring building, Cook Auctions, located at 3818 River Road N. The employee called the business owner, Rocky Cook, thinking there was a broken water pipe inside. When the Cook arrived and opened the door they found smoke inside. They exited the building and called 9-1-1.

When firefighters arrived they found smoke throughout the building and a small fire in the bathroom. Captain Brian Butler stated "the business owner was very lucky as the toilet and sink had both broken causing a water leak that kept the fire small. Had that not occurred the entire building could have been a loss."

Damage was confined to the bathroom with some damage in the main portion of the building. No injuries were reported and the fire is still under investigation. Two engines, one medic, one duty officer vehicle, one fire investigation vehicle and 15 firefighters responded to the second fire.

Governor Kitzhaber's seven-member Public Safety Commission meets today in Salem for the first of four statewide meetings on comprehensive sentencing reform. The October prison population forecast is due to be released today, as well. One area of review is the growth in prison population from 1995-2011. This is particularly important because the costs of incarceration are significant.

The Commission's work plan recommends any reform be based on "fiscally responsible data driven policies and practices." Prosecutors rely on evidence. Evidence-based data is crucial to making good policy choices. The District Attorneys have compared the historical projections to actual prison populations and found that the forecasted populations, on average, range from being high by just under 1% in the first year of the projection to 5% in year 5 to 12% over actual populations in year 10. These overages seem small as a percentage, but they result in predictions which are high by numbers that amount to entire prisons. For example, on average, the year 5 projections equate to 716 inmates more than the actual population. Year Ten is off by 1,692 inmates, the size of the Eastern Oregon Correctional Institution, or three 500-bed prisons.

Cost appears to be an important consideration of the Commission and the Legislature in determining how long sentences should be. Projecting prison populations is an inexact science and should not be the grounding factor to change public safety policy. The Commission should be cautious in its reliance on historically inexact or inflated data.

Three long-term members of the Marion County Sheriff's Office recently announced their retirements. They will take with them, 91 years of law enforcement experience.

Lieutenant Bob Stai's retirement date is November 1st. Lt. Stai started his law enforcement career 38 years ago, as an intern for the FBI in Seattle, After finishing college his employment included brief stints with the King County Juvenile Probation Department, Stayton Police Department and the Keizer Police Department before joining the Marion County Sheriff's Office in 1990. He was promoted the Sergeant in 1996 and Lieutenant in 1999.

Lt. Stai was assigned to the Enforcement Division. His favorite assignments included working the Homicide/Assault Response Team (HART) and the Domestic Violence Team. He characterized his career by saying "Nothing surprises me anymore; every day was different … filled with challenges".

Undersheriff Troy Clausen captured his legacy, "Lt. Bob Stai served this community for many years. Senior Deputy Mark Peterson's retirement date is October 1st. Deputy Peterson began his career in 1980 as a Correctional Officer at the Oregon State Penitentiary. He was hired by the Sheriff's Office and became a deputy a year later. He's finishing his career working in the Civil Division, but has worked in virtually every assignment available to deputies.

Deputy Peterson is also a 1st Sergeant for B Company in the Oregon National Guard. He served two combat tours in Iraqi and Afghanistan. Mark plans to continue his service with the National Guard, perhaps return to college to complete his BA degree, and spend time with his wife, Suzie.

Commander Kevin Schultz summarized Peterson's impact on the Office by saying, "Mark's earnest commitment to the residents of Marion County was evident in every contact he made. Because of his tenure, he brought a historical perspective to our Office that will be missed".

A two-month Marion County Sheriff's Office investigation led to the arrest of a 34-year old Silverton man on Tuesday evening.

Arrested without incident and booked into the Marion County Jail was Matthew Michael Marquis. He was charged with four counts of Delivery of a Controlled Substance (Marijuana), four counts of Delivery of a Controlled Substance (marijuana) within 1000' of a school, and being a Felon in Possession of a Firearm.

Detectives from the Street Crimes unit conducted the covert investigation and served a search warrant on Marquis' home in the 900 block of Pine Street in Silverton at 5:45pm.

The basement of the home was dedicated to growing marijuana and was equipped with an elaborate system for lighting and watering the plants. PGE technicians & the Silverton Fire Marshall deemed the electrical wiring so hazardous; the power to the house was turned off until the wiring could be removed.

The search of his residence revealed 99 marijuana plants, 4.25 pounds of packaged dried marijuana, approximately $1900 in cash, scales and packaging materials. The street value of the marijuana is approximately $300,000.

The suspect's home is just down the street from The Community Roots School on North James Avenue.

Marquis is being held on $250,000 bail, and is scheduled for court at 3:00pm, Wednesday, in the Marion County Court Annex.

Senior Deputy Brenda Lumley of the Marion County Sheriff's Office was given The Humanitarian Award by The Lighthouse Farm Sanctuary at a Saturday afternoon function in Scio. The sanctuary makes yearly presentations to deserving recipients.

Sr. Deputy Lumley, a 24-year veteran, was recognized for her investigative work on animal abuse cases. Lumley is very experienced with farm animals and has taken a lead role in the investigation of malnourished and neglected animals in Marion County.

In the past year she has worked with owners who were struggling to feed and care for their animals during these difficult economic times. In some cases, she has arranged for animals to be voluntarily turned into rescue agencies, but in extreme cases she has secured court orders to seize animals whose lives or welfare were in jeopardy.

The road to recovery for these animals is a long one, but with the care provided by non-profit agencies like Lighthouse, virtually every animal seized has been returned to good health.

"We are very fortunate to work with the deputies of the Marion County Sheriff's Office. Knowing we have someone knowledgeable like Brenda that we can count on is a real plus. She is relentless in her dedication to these animals", Founder and Director of Lighthouse Farm Sanctuary Wayne Geiger said.

Marion County Deputies arrested two people after receiving a call that someone was stripping parts from a vehicle in southeast Salem, Sunday evening.

Deputy Jason Bernards got the call at 5:40pm. He drove to the area of Squirrel Hill Road and Delaney Road SE where he found a black 1994 Honda Civic partially hidden in blackberry bushes. A computer check revealed that the car was reported stolen from Portland. Evidence indicated that someone tried to remove stereo equipment from the dash.

Deputy Nicholas Hunter arrived to assist in looking for suspects. He located a male and female nearby. As he spoke with a female, the male suddenly ran away. Other deputies were called to assist and took the suspect into custody 10 minutes after the call.

Bradley R. Gesner, 27, was arrested for Unlawful Possession of a Stolen Vehicle, Possession of a Controlled Substance (Methamphetamine), Failure to register as a Sex Offender, and a warrant for violating a restraining order. Bradley provided no home address and was listed as transient. His bail is $285,000 and he is due in court at 3:00pm, today. (photo attached)

Tamara A. Dolan, 32, of Turner, was arrested on a parole violation warrant for Distribution of controlled Substance (Methamphetamine). She is being held without bail. (photo attached)

Both suspects were booked at the Marion County Jail.

In the last few months, the Polk County Sheriff's Office has seen an increase in the number of reported residential burglaries. To better protect yourself from being a victim of a burglary, we want to point out some tips to make your home less attractive to a burglar. These tips include having good exterior lighting, locking all exterior doors and windows, and keeping valuable items out of sight. While on vacation, have someone pick up your newspapers and mail, so that they do not accumulate and alert burglars of your absence. Work together with your neighbors. Organize a Neighborhood Watch and let your neighbors know when you will be away for an extended period.

Keep jewelry and cash in safe places, such as safe deposit boxes. Make a list of your belongings (be sure to keep receipts, especially for expensive items like stereos, televisions, and computers). Be sure to update this list periodically, and include as much information as you can regarding each item such as brand, model number, serial number, and color, which might later assist investigators in recovering stolen items and apprehending suspects.

If you notice something that seems unusual, like a slow moving vehicle going up and down the street, please call the non emergency number for the Polk County Sheriff's Office at 503-623-9251. If you see what appears to be a crime in progress, call 911.

An autopsy was conducted on Mathew Araki at 1:00pm. According to the Dr. Karen Gunson State Medical Examiner, Mr. Araki died of coronary heart disease.

The District Attorney's will review the completed investigation to determine if any charges will be filed on anyone involved in the dispute.

At approximately 4:52am, Marion County Deputies were called to the scene of a disturbance in the parking lot of the Brittany Crossing Apartments in NE Salem.

Sr. Deputy Jerry Wollenschlaeger arrived at 433 Brittany Way NE within minutes and found a 38-year old male lying unconscious on the sidewalk. Wollenschlaeger immediately requested medics be dispatched to the scene and began providing CPR. In spite of his efforts, the victim was pronounced dead at the scene. He is identified as Mathew Araki. Araki's home address is not known; it is believed he was visiting friends at the apartment complex.

Marion County Detectives are being assisted by Detectives from the Keizer Police Department and the Oregon State Police. The preliminary investigation indicates that Araki was involved in some type of dispute with an acquaintance. Several witnesses are being questioned by detectives. No weapons were involved.

Representatives from the District Attorney's Office and the Medical Examiner's Office were at the scene to assist in the investigation.

An autopsy will be conducted on the victim to determine the cause and manner of his death. His family has been notified and is being assisted by their pastor. They are requesting privacy to deal with their emotions.

Co-Conspirators sentenced in Polk County double homicide case

Today, Andrew Jondle, 21, was sentenced to a 50 year minimum life sentence and Cindy Lou Beck, 47, was sentenced to 20 years for their respective roles in the 2010 slaying of David Scott Jondle and Marilyn Ruth Jondle. The Jondle's were found dead on August 31, 2010 at their farm on Gilliam Road in unincorporated Polk County, Southwest of Dallas. The killings initially made national headlines, in large part due to the fact that Andrew Jondle used a reaping scythe as one of the murder weapons.

Today's sentencing proceedings were the result of pleas entered earlier this summer. Judge Eric Bergstrom, of Multnomah County handed down sentences during two separate hearings held today in the Polk County Courthouse. The out of county judge had been assigned to facilitate settlement conferences which ultimately led to the pleas.

Cindy Lou Beck, received a 20 year sentence for her role in the murders. Beck had already pleaded no contest to two counts of Conspiracy to Commit Murder on August 30, 2011, but the sentence was pronounced today. Polk County District Attorney, Stan Butterfield, said at the hearing that. Beck had conspired with Andrew Jondle to murder Jondle's parents, and also said that Beck had used a scam form of "psychic channeling" to manipulate Andrew Jondle into actually carrying out the murders.

Beck met Andrew Jondle at the beginning of July 2010 and shortly thereafter he moved into her Salem apartment. Within 60 days of living together, the two hatched a number of schemes for killing Andrew Jondle's parents. Beck was able to convince Andrew Jondle to kill his parents by pretending to receive messages from animal or tree spirits. Defense attorneys had Andrew Jondle tested during the course of the case and determined that Andrew Jondle was not mentally retarded or insane, but that he was of limited intelligence and very gullible. Andrew Jondle expressed in an interview with law enforcement officials earlier in the summer that he had killed his parents because the spirits through Beck had told him they needed to die so his parents wouldn't harm Beck's children. He further said the rent money that he stole and the possibility of inheriting proceeds from the sale of his parent's farm were, "…just an added bonus."

The two had come up with several plans that would have left the appearance of an accident. When it came time to actually put the plans into action, Andrew Jondle used their fall back plan. The back-up plan was to make the murders look like part of a home invasion burglary.

The Department of Human Services (DHS) had taken Beck's two children into custody several months before the murders. Beck appears to have been motivated solely by her need for money. She needed money to prevent an eviction from her apartment and to prove to the state that she had the means to properly care for her children.

Butterfield said he originally sought the death penalty for Andrew Jondle, but as the case unfolded, he reconsidered. "Andrew Jondle agreed to cooperate with the state in our case against Cindy Beck, if he hadn't I would not have agreed to the life sentences with the 50 year minimum." Butterfield said. Andrew Jondle pleaded guilty to two counts of Aggravated Murder and one count of robbery in July. Today the judge gave Jondle a sentence of life with a 50 year minimum. After 50 years he can ask the state for parole.

The murdered couples' other two sons, as well as Marilyn Jondle's brother, mother and step-father were present in the courtroom for the sentencing proceedings. In July and August the victim family members were consulted as part of plea negotiations between the state and the attorneys for the two defendants and were supportive of a settlement rather than going forward to trial.

At approximately 8:00am, Marion County Deputies Peter Marcellais and Steven Duncan responded to a single-vehicle crash on Aumsville Highway, near Joseph Street SE in Salem. The crash conditions included light rain and wet roads.

A 1997 Mitsubishi was traveling westbound on Aumsville when it failed to negotiate the turn and skidded off into the ditch alongside the roadway. The driver was uninjured but his vehicle had to be towed from the scene. Fortunately, the damage to his car was relatively minor.

This crash provides us with an opportunity to remind all motorists that rain makes for slippery roads, especially when it has not rained in a long time. This is because greasy substances like lubricants and oil drip from cars as people drive, and these substances accumulate on the surface of the road until they are washed away. The first rain can loosen these greasy materials, creating an oily slick on the surface of the road which can make driving very dangerous. If you drive after rain, you need to be aware that this slick can interfere with your ability to drive, especially at high speeds.

While driving in the rain, you also have to contend with poor visibility. Driving slowly and staying focused will reduce accidents which may cause damages, injuries, or loss of life.

Excessive speed and reckless driving landed a 31-year old motorcyclist in jail today following his arrest near Mehama. At approximately 3:45pm, Sr. Traffic Safety Deputy Jeff Nicoloff observed a 2003 Honda VTR-1000 motorcycle traveling westbound on Highway 22, near milepost 24.

The motorcycle was travelling at a high rate of speed as it rounded a curve in the roadway. Its inertia caused it to swerve into the oncoming eastbound lane of travel before the driver was able to regain control. Deputy Nicoloff saw that the motorcycle had both a driver and passenger. Using LIDAR, Nicoloff was able to verify the vehicle's speed at 108mph in the 55mph zone.

After stopping the motorcycle, he learned that the driver was driving without a valid license, had no insurance, and was also wanted in the state of Florida for failing to pay child support payments. He was identified as Steven T. Sharp, 31, of Portland. The passenger was identified as his current wife. Sharp offered no explanation for his driving.

Sharp was arrested and booked into the Marion County Jail on charges of Reckless Driving and Reckless Endangerment. His motorcycle was impounded. His wife released at the scene without charges.

The state of Florida will not extradite the subject on the warrant, so that charge was not added to his booking. Sharp will be in court at 3:00pm, September 19th. His bail is $10,000.

Comedy Murder Mystery-Oct. 8th-Salem Red Lion Hotel

Hi Salemites,

Hope that this email finds you well.  I am looking for ways to get the word out about our upcoming comedy murder mystery performance of "So Long Saloon: How The West Got Dead!"  This is our very first event in the Salem area, and we are looking forward to doing many more.  But since our show is dinner theatre, we need to let people know about our show at least two weeks prior to the event, because people must reserve their seats in advance.  Do you have any ideas (aside from posting the event on your website) that might help let people know about us?  Do you happen to have a Facebook page or email newsletter that you could help us out with?  We'd really appreciate it!

Here's a little background on Poison Pen Players.  We are headquartered in Florence, but are originally from Los Angeles area.  We have been in the "business of murder" for over 14 years now, and have traveled the USA performing for folks in all walks of life, including many "big wig" corporate clients such as Kaiser, Nike, Pepsi, Sprint and the Walt Disney Corporation.  We also regularly perform for Three Rivers Casino in Florence.  Our last show sold out to over 750 guests in one weekend!  Our murder mysteries are all original, fully scripted, written by our team of authors, and feature many over the top characters and hilarious situations.  The audience gets to actively participate in solving a crime, with the help of our detective character, while enjoying a delicious three course meal.  The murder occurs right before their eyes, and they all become detectives themselves.  By the time dessert is served, they must vote for the person whom they believe did the dirty deed.  And the winning team gets a prize.

This particular show is very fun!  It is based in the late 1800's Wild West, and several of the characters get transformed into werewolves mid-show.  We will be touring throughout OR with "So Long Saloon," and are excited to be performing in Medford, Eugene, Florence, Elkton, Coos Bay, Turner, and more!   Here is our current schedule:  http://www.poisonpenplayers.com/specialevents.html

Delilah Rose - A Saloon Girl with a heart of gold, feet of lead, and brain of feathers.  Delilah wakes up every day to a whole new and exciting world, and then she falls out of bed.   (Played by Melanie Heard)
Idaho Harvey – Jezebel's former husband.  Apparently back from the dead.  Or smells like it.  (Played by Mike Jacobson)
Jezebel Harvey - Owner of the So Long Saloon and Madam extraordinaire.   (Played by Victoria Seitzinger)
Thomasina  "Thom"  Jones  -  A  rip roarin',  Bronc wrestlin', kinda' cowgirl whose herd is mysteriously disappearing. (Played by Judy Adams)
Gawain Newton – This cowboy is madly in love with Thomasina Jones.  She won't give him the time of day unless he "cowboys up".  Gawain picks an unexpected way to do so. (Played by Mat Alexander Korso)
Colonel Winston Montague  -  An English gentleman of many talents who arrives at the So Long Saloon in the company of Idaho Harvey and stumbles into a very strange evening!  (Played by Jason Wood)
