Body recovered in the Willamette River

BODY RECOVERED IN THE WILLAMETTE RIVER

On 10-01-11 at 2:29 PM Polk County Sheriff's Office deputies responded to a report of a body floating in the Willamette River in Buena Vista, an unincorporated area of Polk County south of Independence, OR. Also responding were Polk County Fire personnel, assisted by the Salem Fire Department water rescue boat team.

By 3:24 PM fire units had located and confirmed the presence of a dead body, approximately one quarter mile downstream (north) of the Polk County side of the Buena Vista Ferry landing. The body was later recovered by authorities at approximately 4:40 PM with the assistance of a boat operated by the Benton County Sheriff's Office marine patrol unit.

The body was identified as that of 63 year old Marvin Leonard Studer, a resident of the Buena Vista area. Studer had last been seen by family members September 9, 2011 at his home, a short walking distance from the Willamette. Relatives have indicated that it was not uncommon for Studer to spend time along the river. While cause of death and the reason for Studer being in the water have yet to be determined, there was no indication of foul play at the scene. Investigation by the Polk County Sheriff's Office will continue.

They initiated procedures to stop the train, but the 2-engine, 2700' long freight train took almost a mile to stop. They were unable to avoid hitting the female.

Tip-A-Cop Program Benefits Special Olympics

A dozen Marion County Sheriff's Office employees and volunteers rolled up their sleeves and worked with the wait staff at the Applebee's restaurant on Lancaster Drive Thursday evening, September 22nd. It was all for a good cause; raising money to support the Special Olympics.

This was the 3rd year our Office has participated in the Tip-A-Cop program. Deputies, Office staff, Cadets and a Commander interacted with the patrons and collected a total of $1100 for the program.

"This was a wonderful opportunity to give back to our community. The patrons and restaurant staff were both pleased that we were there. I came away with a new-found respect for the wait staff at Applebee's. They're awesome" Commander Sheila Lorance commented.

Keizer Fire has a busy Night

Keizer Fire District firefighters were kept busy last night with two structure fires and five medical calls. The first structure fire was reported to 9-1-1 at 7:51 pm, when the Nichelle Martin was cooking dinner and smelled burning plastic. She checked the laundry room and kitchen area, but couldn't locate the source of the smell. One of her sons noticed smoke coming from the bathroom door, which was only open a crack. Upon opening the door fully they saw smoke and flames. The family then evacuated the house and called 9-1-1.

When firefighters arrived at 4915 Wolf St N, they found smoke throughout the home, and the bathroom on fire. The fire was quickly extinguished. Fire damage to the home was confined to the bathroom with smoke damage in parts of the house.

The home is owned and occupied by Robert Chapman, his fiancé Nichelle Martin, their six children, and roommates Elliot and Ashley Trimble and their son. They had a smoke alarm in the home; however it did not work. The home is insured and the family was able to stay there last night.

Two engines, one medic, one duty officer vehicle, one fire investigation vehicle and 11 firefighters responded to the incident. No injuries were reported and the cause of the fire remains under investigation.

The second fire was reported to 9-1-1 at 2:42 am when a paint shop employee was leaving work for the night noticed water coming out from the neighboring building, Cook Auctions, located at 3818 River Road N. The employee called the business owner, Rocky Cook, thinking there was a broken water pipe inside. When the Cook arrived and opened the door they found smoke inside. They exited the building and called 9-1-1.

When firefighters arrived they found smoke throughout the building and a small fire in the bathroom. Captain Brian Butler stated "the business owner was very lucky as the toilet and sink had both broken causing a water leak that kept the fire small. Had that not occurred the entire building could have been a loss."

Damage was confined to the bathroom with some damage in the main portion of the building. No injuries were reported and the fire is still under investigation. Two engines, one medic, one duty officer vehicle, one fire investigation vehicle and 15 firefighters responded to the second fire.

Fire officials would like to remind residents to check your smoke alarms to ensure they are in working order. There should be at least one smoke alarm in every home, placed outside of sleeping areas. For two story homes a smoke alarm should be placed on each floor.

Keizer Fire recommends a smoke alarm on each floor, one in each bedroom and a smoke alarm outside the sleeping areas. This helps to ensure quick notification in case of a fire.

Governor Kitzhaber's seven-member Public Safety Commission meets today in Salem for the first of four statewide meetings on comprehensive sentencing reform. The October prison population forecast is due to be released today, as well. One area of review is the growth in prison population from 1995-2011. This is particularly important because the costs of incarceration are significant.

The Commission's work plan recommends any reform be based on "fiscally responsible data driven policies and practices." Prosecutors rely on evidence. Evidence-based data is crucial to making good policy choices. The District Attorneys have compared the historical projections to actual prison populations and found that the forecasted populations, on average, range from being high by just under 1% in the first year of the projection to 5% in year 5 to 12% over actual populations in year 10. These overages seem small as a percentage, but they result in predictions which are high by numbers that amount to entire prisons. For example, on average, the year 5 projections equate to 716 inmates more than the actual population. Year Ten is off by 1,692 inmates, the size of the Eastern Oregon Correctional Institution, or three 500-bed prisons.

Cost appears to be an important consideration of the Commission and the Legislature in determining how long sentences should be. Projecting prison populations is an inexact science and should not be the grounding factor to change public safety policy. The Commission should be cautious in its reliance on historically inexact or inflated data.

Three long-term members of the Marion County Sheriff's Office recently announced their retirements. They will take with them, 91 years of law enforcement experience.

Lieutenant Bob Stai's retirement date is November 1st. Lt. Stai started his law enforcement career 38 years ago, as an intern for the FBI in Seattle, After finishing college his employment included brief stints with the King County Juvenile Probation Department, Stayton Police Department and the Keizer Police Department before joining the Marion County Sheriff's Office in 1990. He was promoted the Sergeant in 1996 and Lieutenant in 1999.

Lt. Stai was assigned to the Enforcement Division. His favorite assignments included working the Homicide/Assault Response Team (HART) and the Domestic Violence Team. He characterized his career by saying "Nothing surprises me anymore; every day was different … filled with challenges".

Undersheriff Troy Clausen captured his legacy, "Lt. Bob Stai served this community for many years. His knowledge and expertise in the field of investigations cannot easily be replaced and he was admired by his peers for those abilities. Bob has always been dedicated to this profession. He has mentored many of us still here at the Sheriff's Office and he'll be missed tremendously".

Senior Deputy Mark Peterson's retirement date is October 1st. Deputy Peterson began his career in 1980 as a Correctional Officer at the Oregon State Penitentiary. He was hired by the Sheriff's Office and became a deputy a year later. He's finishing his career working in the Civil Division, but has worked in virtually every assignment available to deputies.

Deputy Peterson is also a 1st Sergeant for B Company in the Oregon National Guard. He served two combat tours in Iraqi and Afghanistan. Mark plans to continue his service with the National Guard, perhaps return to college to complete his BA degree, and spend time with his wife, Suzie.

Commander Kevin Schultz summarized Peterson's impact on the Office by saying, "Mark's earnest commitment to the residents of Marion County was evident in every contact he made. Because of his tenure, he brought a historical perspective to our Office that will be missed".

Undersheriff Clausen added, "Mark Peterson has been a mentor and friend to many people during his career. He is the epitome of an American hero. For over 30 years, he's put his life on the line for his community and his country. Mark's personality is "no nonsense, tell it like it is". That's what makes him great. Marijuana Dealer Arrested by Street Crimes Detectives

A two-month Marion County Sheriff's Office investigation led to the arrest of a 34-year old Silverton man on Tuesday evening.

Arrested without incident and booked into the Marion County Jail was Matthew Michael Marquis. He was charged with four counts of Delivery of a Controlled Substance (Marijuana), four counts of Delivery of a Controlled Substance (marijuana) within 1000' of a school, and being a Felon in Possession of a Firearm.

Detectives from the Street Crimes unit conducted the covert investigation and served a search warrant on Marquis' home in the 900 block of Pine Street in Silverton at 5:45pm.

The basement of the home was dedicated to growing marijuana and was equipped with an elaborate system for lighting and watering the plants. PGE technicians & the Silverton Fire Marshall deemed the electrical wiring so hazardous; the power to the house was turned off until the wiring could be removed.

The search of his residence revealed 99 marijuana plants, 4.25 pounds of packaged dried marijuana, approximately $1900 in cash, scales and packaging materials. The street value of the marijuana is approximately $300,000.

The suspect's home is just down the street from The Community Roots School on North James Avenue.

Marquis is being held on $250,000 bail, and is scheduled for court at 3:00pm, Wednesday, in the Marion County Court Annex.

Deputy Recognized for Humanitarian Work

Senior Deputy Brenda Lumley of the Marion County Sheriff's Office was given The Humanitarian Award by The Lighthouse Farm Sanctuary at a Saturday afternoon function in Scio. The sanctuary makes yearly presentations to deserving recipients.

Sr. Deputy Lumley, a 24-year veteran, was recognized for her investigative work on animal abuse cases. Lumley is very experienced with farm animals and has taken a lead role in the investigation of malnourished and neglected animals in Marion County.

In the past year she has worked with owners who were struggling to feed and care for their animals during these difficult economic times. In some cases, she has arranged for animals to be voluntarily turned into rescue agencies, but in extreme cases she has secured court orders to seize animals whose lives or welfare were in jeopardy.

The road to recovery for these animals is a long one, but with the care provided by non-profit agencies like Lighthouse, virtually every animal seized has been returned to good health.

Marion County Deputies arrested two people after receiving a call that someone was stripping parts from a vehicle in southeast Salem, Sunday evening.

Deputy Jason Bernards got the call at 5:40pm. He drove to the area of Squirrel Hill Road and Delaney Road SE where he found a black 1994 Honda Civic partially hidden in blackberry bushes. A computer check revealed that the car was reported stolen from Portland. Evidence indicated that someone tried to remove stereo equipment from the dash.

Deputy Nicholas Hunter arrived to assist in looking for suspects. He located a male and female nearby. As he spoke with a female, the male suddenly ran away. Other deputies were called to assist and took the suspect into custody 10 minutes after the call.

Bradley R. Gesner, 27, was arrested for Unlawful Possession of a Stolen Vehicle, Possession of a Controlled Substance (Methamphetamine), Failure to register as a Sex Offender, and a warrant for violating a restraining order. Bradley provided no home address and was listed as transient. His bail is $285,000 and he is due in court at 3:00pm, today. (photo attached)

Tamara A. Dolan, 32, of Turner, was arrested on a parole violation warrant for Distribution of controlled Substance (Methamphetamine). She is being held without bail. (photo attached)

Both suspects were booked at the Marion County Jail.
