On Saturday, July 23, 2011, Dr. Larry Lewman, Oregon State Deputy Medical Examiner performed an autopsy upon the body of Albert G. Hopkins. He determined that Mr. Hopkins died as a result of a homicide by firearm. This homicide occurred within the city limits of Mt. Angel, Oregon on July 22, 2011. Timothy D. Davis of Mt. Angel was arrested later that evening in regard to this homicide. He was lodged in the Marion County Jail on charges of Murder and 2nd Degree Assault. He is being held without bail until his first appearance on Monday July 25, 2011 at the Marion County Court Annex, 9000 Aumsville Highway, Salem, Oregon. The afternoon in custody arraignments are scheduled for 3 p.m.
On Monday, prior to his arraignment the Marion County District Attorney's Office will file an information charging Davis with 1st Degree Murder with a firearm and 2nd Degree Assault with a firearm. At the time of arraignment Davis will receive a Court Appointed Attorney. At that time a preliminary hearing date and a date for arraignment on indictment will be set. The District Attorney's Office will submit this case to the Grand Jury within a week. The date and time have not be set. If the Grand Jury returns a true bill of indictment there will not be a preliminary hearing.
Under Oregon law, the sentence for Murder is Life in prison with a 25 year minimum. Under Oregon Law, the maximun sentence for 2nd Degree Assault is 10 years in prison. A felony crime when committed with a firearm carries a 60 months firearm minimum.

The Marion County Grand Jury met today, July 27, 2011. The Grand Jury returned an indictment charging Timothy D. Davis with Murder with a Firearm and Assault in the Second Degree with a Firearm. Based upon this there will not be a preliminary hearing on August 1, 2011. The next court appearnce will be for arraignment on Indictment on August 3, 2011 at 8:30 a.m. at the Marion County Court Annex. Mr. Davis continues to be held in the County Jail with no Bail on these charges. At the time of arraignment an entry of plea date will be set.
